Collaborative Law

What are the Goals?

• Ending the marriage or dispute in an orderly fashion.
• An equitable settlement agreement that is acceptable to both parties.
• Do the least harm in order to promote a civilized family relationship in the future.
• Focus on the future not on all the faultfinding and details of the past.

What are the Advantages?

• Cases are resolved much faster.
• Costs to clients is much less.
• Families are not destroyed by the process.

What are the other Considerations?

• If one of the parties insists that his or her lawyer violate the agreed upon terms, or chooses to drop out of collaborative law and file suit, the lawyers must withdraw from the case.
• If either party is operating in bad faith, collaborative law will not work.
• Collaborative law is not appropriate when a relationship involves abuse, or when parties don't want to cooperate.
