  1. What is the most common ground for divorce?

    Insupportability is the most common ground for divorce. It is a “no fault” ground and simply states that the husband and wife are no longer able to live together as a married couple and that there is no reasonable expectation of reconciliation. 

  2. How long do I have to wait until I can finalize a divorce in Texas?

    After the filing of a Petition for Divorce, it is necessary to wait for sixty (60) days (a “cooling off period’) before it is possible to finalize the divorce. 

  3. Is there a residence requirement to get a divorce in Texas?

    It is necessary for a person to be a resident of the State of Texas for six (6) month and a domiciliary of the county within the state for ninety (90) days before that person can file a Petition for Divorce. 

  4. Is it possible to get child support for a child who is over eighteen (18) years of age in Texas?

    It is possible to receive child support for a disabled child over the age of eighteen (18) years and for a child over eighteen (18) years of age who is still attending high school to obtain a diploma for graduation. 

  5. What do I do if I am served with divorce papers?

    If a person is served with divorce papers by a sheriff, constable, pr private process server, the person has until the first Monday at 10:00 a.m. after twenty (20) days after service to file an “Answer” with the Court, or to obtain a lawyer to do so.
